Okay, now I have been silent on this board for some time because there are a great deal of you whose opinions I do not agree, but when it comes to this and the parroting that is being done of news media, you just sound like DAMN FOOLS about this topic!

The Hero Bill is a long and convoluted history.

If you want the long and short of it, The vast majority of the bill was a good bill. The only part most of Houston had problems with, 61% of those who voted on Tuesday November 3rd, had was with the clause regarding bathrooms and locker rooms. In reality what it said was that a man could enter the women's bathroom, shower room or locker room. Now with most transgenders this isn't a problem really once you get down to it. Short of groping a persons crotch or running an X-ray machine by the front door into such places, how is anyone going to know? A guy dressed in a woman's sun dress is not going to arouse much suspicion. Now if that man looks like a man and dresses like a man and goes in the women's bathroom, he will. That was the complaint. A Person could just decide to say "Oh. Today, I am not Samuel, I am Samantha and I am going to use the women's bathroom, even though I look like Samuel."

If Samuel wants to be Samantha and act like Samantha, he needs to have an outward portrayal of Samantha and people may even call him Samantha or "Ma'am." Otherwise, he looks like a pervert walking into the girl's bathroom. It really is the major complaint. And if you had young daughters in the bathroom using the bathroom, you as a father or mother would want some level of protection for your child(ren).

Hey, it seems you missed the entire argument but that's okay because most of Houston did too!

Under HERO it would have protected transgender people (regardless of if they're 'passing') from harassment or discrimination in not just the restrooms but work, school, etc. It would have also made it legal for a person to use a bathroom that corresponds to their gender identity.

The problem is a PERVERT wrapping him or herself in the mantle of protection  that such a law would provide. If for instance a child molester molests a little girl in the girl's bathroom, is caught finally, goes to jail, is hauled into court and is facing charges to put them away for 5 or 10 years, don't you think that maybe they might say they were transgendered and had a right to be in the bathroom in the first place?

Do you realize with that law, that the police arrest is therefore null and void, the prosecution has to throw out that case and then the perverts goes SCOT Free to victimize again?

That is where it turns to perverse. . 

If a man disguises as a woman and goes into a women's restroom with the intent to harm someone, that was already illegal..

Not only because sexual assault is already illegal but also because going into a bathroom that doesn't correspond to your gender is illegal

So, if someone rapes in a bathroom for the other sex, your only problem is with it happening in the other sex'es bathroom, not the fact that rape was commited? The only charge should be the fact that it happened in the wrong bathroom, not that it actually happened?

By that crazy logic, Steve, the totally heterosexual owner of Bropiddle.com, who secretly films men peeing in public restrooms for his website that might be pornographic but maybe it's just for comparative medical research or at least that's how some customers explain it to their wives, is ALSO a criminal!  HOW COULD THAT BE!?  HE'S ALLOWED TO BE IN THE MEN'S RESTROOM, THAT MAKES HIS ACTIONS FOR BROPIDDLE.COM TOTALLY LEGAL, RIGHT?  If dudes didn't want to be secretly filmed peeing, they should have held it till they got home!

Like, you have to be pretty stupid to think that that's how these things work.  As a transsexual women in Canada, where it would be a violation of my civil rights to bar me from any women's restroom, where my employer could be fine like thousands upon thousands of dollars, much of which would be awarded to me, for attempting to bar me from the womens restroom, I assure you that it is still very much a criminal act for me to rape my coworkers in that bathroom.  (Not that anyone at my workplace knows that I'm trans, but that's not really the critical point here)

Can you please cite the exact language in the Houston Equal Rights Ordinance that legalized the sexual assault of children?  Now, to be certain, I am only a Canadian and sometimes your wacky system confuses me, but I am of the understanding that criminal laws primarily determined by the state and it's legislature, and that by matter of legal supremacy, no municipality could pass a law that counters the state's criminal laws.  As such, no municipality could legally protect a child molester or rapist, counter to the state's sexual assault laws.

It's common knowledge that trains and fags violate children you queer. You don't need documents to reaffirm it.

Is the women's room cleaner? My sister used to clean the washrooms at the retail place she worked at and she had horror stories galore. I can't think of many situations where the men's stalls would be covered in blood.

But yes... generally woman's restroom is cleaner, even heard they have those toilet seat warmer.

A loooong time ago someone shat on the floor in the men's restroom so I had a friend watch the door as I used the girl's. It was cleaner.

No such language governs that it will enable child molesters to act upon their predilections and victimize little girls in the bathroom, but it does not take a genius to figure out that a jerk in trouble with the law would not use the argument as a crutch to get out of prison. Lawyers have one goal, get their client off without serving jail time. It does not matter if they are guilty, The 'system must be maintained" and if justice is raped in a case, then it is the system fails; not the sleaze-bag lawyer using weasel tricks to get around and skirt around the law. Most of the child molesting cases are really terribly hard to prosecute. The lack of evidence, the fact that the child who is hurt is too hurt and ashamed to come forth right away. Oftentimes it takes other periphery behavior patterns to catch such people. 

And I have only looked at one side of this, not the other. I have only covered the side where a man walks into the women's bathroom, not a woman walking into the men's bathroom. There is the possibility of women going into the men's bathroom with with the express purposes of fulfilling contracts for sex and prostitution, which is illegal in Texas. If you want prostitution there is Nevada which has had it for a while now and Maine as I understand it has within the past few years legalized prostitution.

 

The problem with having a public bathroom with both genders in it is that it will eventually require police presence in the bathrooms. The current law where only one gender per bathroom really keeps that all in check currently.

Gendered restrooms are predicated on the idea that women will be sexually harassed by men in an unsegregated environment but instead it just means I never have to wait in line to take a piss in a packed venue.

I can vouch for this, I once missed a movie's ending at a theater because they only had one bathroom and the line was so fucking long.

Needless to say the theater didn't stick around for very long.

I'm very puzzled by single occupant public restrooms that are gendered.  Like, a bathroom with a locking door, and inside is the toilet, sink, and whatever, but there's TWO of these rooms and one marked 'Men' and the other 'Women'.  WHY?  THEY ARE PRIVATE INDIVIDUAL BATHROOMS.  Oh wait, the Women's restroom has one of those diaper changing tables and the bin for hygene products?  Cool, put those in the other bathroom and now you just have 'Two Bathrooms'.  This is more efficient and requires basically no effort.  If someone owned a house with two bathrooms they wouldn't gender them, they'd just have TWO BATHROOMS.

 

Oh, and the worry that I'm going to be reprimanded for using the "wrong" one means that I end up sneaking in and out of those bathrooms like some kind of toilet ninja.

In reality, it doesn't matter, and to my way of thinking, it cuts down on people needlessly waiting in line for "their" bathroom.

As for "not all men," my understanding is that it's considered annoying because people will want to have a serious discussion about rape prevention, consent, safety, or feeling unsafe in certain settings, and it'll inevitably be derailed by people trying to desperately polish their own goodguy badge by insisting THEY AREN'T THAT WAY, when no one said they were.

Oh, and stop playing pat-a-cake with the village idiot, please, people; it's what he wants.

Yeah, there's absolutely nothing horrifying about making the insignificant offense of using the improper restroom a substitute for child rape prosecution. I'm sure such a law would never be used to completely screw over transgender people.

What!?!? Being transgender sounds like the money ticket! How to be rich:

1) Go to opposite gender restroom and hope a manager tries to stop you

2) wip out that fancy ass transgender card 

3) sue for discrimination or whatever

4) retire early or get new job and rinse/repeat

Should be some kinda requirement before being legally labeled a transfolk. Must look the part, have the bits, have a license, something on your ID and driver's license, something! Nothing to spot folks from reaping the rewards of being trans when it works for them and then ditching it when things gets bad. I know many people would kill to be able to pass as black when they want. Throw the race card, not feel weird when they walk into an all black barber shop, church, cook out, whatever. Be able to act like a ghetto hoodrat and not be judged for trying to be 'black'.

Lomberdia has it.  That's my plan.  I'm just waiting to be dehumanized by my employer, then spend 12-18 months going though my provence's Human Rights Tribunal, then get awarded something in the area of $50 000-$150 000 after all of that time.  Of course I'd seriously risk being unofficially blacklisted in my industry for 'starting problems', something that would be a LOT harder to prove in a human rights tribunal assuming an employer is smart enough to just pass on an applicant rather than say 'NO TRANNY FAGGOT SHIT DISTURBERS ALLOWED!'.  I'd be set for... 1-4 years, assuming I managed to maintain financially table for the 12-18 month tribunal process where I could either retrain for an ENTIRELY new industry (I do NOT work in a large industry, getting black listed would not be hard if I fucked something up big time like stole movie leaks or wisked away IP) or retire to a nice cardboard box under a bridge because it's not like I'd win 10 million dollars or something!

...Ooooooooooor, I could enjoy that I live in a place where employers, especially large corporations, do not discriminate against employees for fear of human rights tribunals, plug away at my hours, rack up some OT, and pay my fucking rent.  Hmm, Lomberdia's stupid bullshit where he thinks being trans is like landing on Free Parking or just no discrimination and full time employment?  Gosh, decisions, decisions.

What disgusts me is how people manage to paint themselves into virtuous moral crusaders while basically ganging up on a group of people who are at a markedly increased risk for experiencing discrimination, homelessness, assault, rape, and murder, on the grounds that they're somehow the real bullies.

Hormone levels slightly out of balance relative to a normative sample group? Then you can't properly be considered "cis," because you're clearly not a "real" normative male or a "real" normative female.

Any people NOT of European descent in your family tree? Then you have no right to call yourself "white," you shifty octaroon you.

Dated someone of the opposite sex once? Hand over your gay card, you filthy breeder!

Briefly lusted after a celebrity of the same sex once? Your straight license has been revoked, you queer!

After all, we can't have people trying to "pass" for the sweet perks. We must keep the natural boundaries between human groups clear and unambiguous, as the Good Lord intended.

In all seriousness the molestation and rape is going to be more of an issue now that the law is bringing attention to it.

Before: transgender people were using their bathroom for its intended purpose. Most of which you probably would never know were transgender because odds are they likely pass well enough to be comfortable using the same-gendered restroom as themselves. The ones who dont pass as well probably somewhat looked the part, and nobody batted an eyelash at the vaguely masculine/feminine figure who walked in, did their business, walked out.

Cant say trans people havent been discriminated in walking in there, though. But most wouldnt go in there to look for trouble, I would think.

After: People start noticing trans people exist among them and are walking into opposite sex bathrooms, people get panicked and scared and start making laws because it makes them uneasy and they perceive a threat. They make claims that these people are just pervs and are likely just doing it for eye candy/molestation/rape (despite the fact that non-straight people exist and could be doing this, despite the fact that opposite sex people already find other ways to commit crimes and walk into opposite sex bathrooms to do illegal stuff). People notice these claims and take advantage of the divergences in public opinion, likely someone who already had a prejudice towards the group, pretended to be them, and commited an act using the popular hot topic as a safety net for a horrible action

 

Which is just an extension of what I already said, if pretending to be trans wasnt an issue before, Im almost certain some jerk is going to make it an issue now, and politicians will go "See? See? Told you so!"

It's mind boggling that society's first reaction to anything involving more than one gender in the same place is the "this is gonna lead to rape" mentality, as if that's the first thing on anyone's mind when they see someone of another gender. So, god forbid, we can't allow laws like this to protect people because someone might "exploit it" somehow. Also, it says a lot about the subconscious of the people who come up with these wild scenarios if their first thought when shown these things is "but then everyone's just gonna use it as a pass to sexually assault everyone!".

Apparently to these people, the mass majority of society is apparently so vehemently animalistic that self-control and morals don't exist and when given any freedom, our first instinct will clearly be to exploit it to commit sexual assault.

Texas, you can only deny civil rights for so long. And you make yourself look a fool while you do. The South has always suffered under this sorta hateful disease. It helps keep it poor and behind the times. :/
